Terms of Purchase

These Terms of Purchase ("Terms") govern all purchases of products and services from Phoenix Grab Bar Supply ("Phoenix Grab Bar Supply," "we," "us," or "our") by customers ("Customer," "you," or "your"). By placing an order with Phoenix Grab Bar Supply, you agree to these Terms.
1. Orders and Acceptance
All orders are subject to acceptance and product availability. An order may be placed through our website, by phone, in person, or through other approved ordering methods.
An order is considered accepted when Phoenix Grab Bar Supply confirms the order or begins processing the order. We reserve the right to refuse, cancel, or limit any order for reasons including product availability, pricing errors, suspected fraud, or other legitimate business reasons.
2. Product Availability
Product availability may change without notice. While we make reasonable efforts to maintain accurate inventory information, products shown as available may become unavailable before an order is processed.
If an ordered product is unavailable, we may contact you regarding an alternative product, revised fulfillment date, or refund of the unavailable item.
3. Pricing and Taxes
Prices are subject to change without notice. The price applicable to your order will generally be the price displayed or quoted at the time the order is accepted.
Applicable sales taxes, delivery charges, and other fees may be added to your order unless otherwise stated.
Contractor, wholesale, bulk, or other special pricing may be available to qualifying customers. Special pricing is subject to approval and may have minimum order quantities or other conditions.
4. Payment
Payment is due according to the terms established at the time of purchase.
Unless an approved account or credit arrangement has been established, orders may require payment in full before pickup, delivery, or shipment.
We may accept various payment methods, including credit cards, debit cards, electronic payments, cash, or other methods offered at the time of purchase.
Phoenix Grab Bar Supply reserves the right to suspend or refuse orders when payment is declined, reversed, disputed, or otherwise not received.
5. Delivery
Phoenix Grab Bar Supply offers Phoenix Metro on-demand delivery, subject to availability and applicable delivery charges.
Delivery times are estimates and are not guaranteed unless expressly agreed to in writing. Delays may occur due to traffic, weather, inventory availability, customer access, or circumstances beyond our reasonable control.
The Customer is responsible for providing an accurate delivery address and ensuring that the delivery location is reasonably accessible.
Unless otherwise agreed, delivery does not include installation, unloading into a specific room or location, removal of existing products, or other installation-related services.
6. Inspection of Products
Customers should inspect products promptly upon pickup or delivery.
If products are damaged, incorrect, or missing, the Customer should notify Phoenix Grab Bar Supply as soon as reasonably possible and, when applicable, before the products are installed or used.
Photographs or other documentation may be requested to assist with damage or discrepancy claims.
7. Returns and Exchanges
Returns and exchanges are subject to the Phoenix Grab Bar Supply return policy applicable to the purchase.
Products must generally be returned in resalable condition and, where applicable, in their original packaging with all included components and documentation.
Certain products may be non-returnable, including special-order, custom, discontinued, clearance, opened, installed, or otherwise designated products.
Return shipping, restocking fees, or other charges may apply where permitted and disclosed by Phoenix Grab Bar Supply.
Customers should contact Phoenix Grab Bar Supply before returning merchandise to obtain return instructions.
8. Special-Order and Custom Products
Special-order, custom, or non-stock products may require payment in advance and may not be eligible for cancellation, return, or exchange once the order has been submitted to the manufacturer or supplier.
Any applicable cancellation restrictions will be communicated to the Customer when reasonably practicable.
9. Manufacturer Warranties
Many products sold by Phoenix Grab Bar Supply are covered by warranties provided by the manufacturer.
Phoenix Grab Bar Supply does not independently warrant products beyond any warranty expressly provided by Phoenix Grab Bar Supply. Manufacturer warranty claims may be subject to the manufacturer's terms, limitations, procedures, and approval.
Customers may be required to contact the manufacturer directly for certain warranty claims.
10. Product Installation and Use
Phoenix Grab Bar Supply sells products for installation and use according to applicable manufacturer instructions and specifications.
The Customer is responsible for ensuring that products are properly selected, installed, maintained, and used for their intended purpose.
Grab bars and related accessibility products should be installed by a qualified professional when appropriate. Installation requirements may vary depending on wall construction, mounting surface, fasteners, location, and applicable building or accessibility requirements.
Phoenix Grab Bar Supply does not assume responsibility for improper installation, misuse, modification, or installation performed contrary to manufacturer instructions.
11. Contractor and Commercial Purchases
Contractors, builders, property managers, businesses, and other commercial customers may be subject to additional account, payment, delivery, return, or pricing terms.
Any approved credit terms or account-specific conditions will apply in addition to these Terms.
Unless otherwise agreed in writing, invoices are due according to the payment terms stated on the applicable invoice.
12. Order Changes and Cancellations
Requests to change or cancel an order should be made as soon as possible.
We will make reasonable efforts to accommodate cancellation or modification requests; however, orders that have already been processed, shipped, delivered, specially ordered, or submitted to a manufacturer may not be cancellable.
Any applicable cancellation charges or restocking fees may apply.
13. Errors in Pricing or Product Information
We make reasonable efforts to ensure that product descriptions, specifications, pricing, and availability information are accurate.
In the event of an obvious typographical, pricing, inventory, or product information error, Phoenix Grab Bar Supply reserves the right to correct the error and, where appropriate, cancel or modify the affected order.
If an order is cancelled due to such an error, any payment received for the cancelled portion of the order will be refunded.
14. Limitation of Liability
To the maximum extent permitted by applicable law, Phoenix Grab Bar Supply will not be liable for indirect, incidental, special, consequential, or punitive damages arising from the purchase, delivery, installation, use, or inability to use a product.
To the maximum extent permitted by law, Phoenix Grab Bar Supply's liability relating to a particular product or order will not exceed the amount actually paid by the Customer for the product or order giving rise to the claim.
Nothing in these Terms is intended to exclude or limit any liability that cannot legally be excluded or limited under applicable law.
15. Force Majeure
Phoenix Grab Bar Supply will not be responsible for delays or failures caused by circumstances beyond our reasonable control, including severe weather, natural disasters, transportation disruptions, supplier delays, labor disruptions, governmental actions, utility interruptions, or other unforeseen circumstances.
16. Customer Information
Customers are responsible for providing accurate contact, billing, shipping, and delivery information.
Phoenix Grab Bar Supply is not responsible for delays or additional costs resulting from inaccurate or incomplete information provided by the Customer.
17. Governing Law
These Terms will be governed by and interpreted in accordance with the laws applicable in the State of Arizona, without regard to conflict-of-law principles.
Any disputes will be handled in accordance with applicable Arizona law and the jurisdiction of courts having appropriate authority.
18. Changes to These Terms
Phoenix Grab Bar Supply may update these Terms from time to time. Updated Terms will become effective when posted or otherwise made available, unless a different effective date is stated.
The Terms applicable to a purchase are generally those in effect when the order is accepted.
